Uttar Pradesh Pollution Control Board is a statutory organization entrusted to implement Environmental Laws and rules within the jurisdiction of the state of Uttar Pradesh, India. U.P. Water Pollution Prevention and Control Board, constituted on February 3, 1975, initially under the Water (Prevention and Control of Pollution) Act., 1974, was consequently rechristened as UP Pollution Control Board on 13th July 1982, subsequent to the enactment of the Air (Prevention and Control of Pollution) Act, 1981.

  • The Uttar Pradesh Pollution Control Board was also entrusted with the powers and functions under the Water (Prevention and Control of Pollution) Cess Act, 1977 along with other responsibilities under the Environmental Protection Act, 1986.
  • Uttar Pradesh Pollution Control Board (UPPCB) registration is a legal document that proves an industry or business is complying with environmental regulations in the state of Uttar Pradesh.

What are the Pollution Categories under UP Pollution Control Board (UPPCB) Consent?

The categorization is based on the relative pollution potential of the industrial sectors and pollutants likely to be generated based on raw material consumption and manufacturing processes adopted. The categorization of Industrial Sectors will be based on their Pollution Index Scores as follows:

  • Red category- Score of 60/more (60+ existing industries)
  • Orange category- Score of 41 – 59 (83+ existing industries)
  • Green category- Score of 21 – 40 (91+ existing industries)
  • White category- Score of 20 or less (192+ existing industries)

1.  White Category

The government has come up with the concept of ‘White Category’ which is launched in an attempt to segregate the least polluting industry. Though, these industries do not require any consent because of their non-polluting nature. The industries falling under this category operates in accordance with UPPCB categories, the white category industry type has a pollution index from 0-20. This is considered the least pollution industry type.

2.  Green Category

Industries with a pollution index of 21 to 40 fall under the Green category. It is essential for these industries to submit consent before forming the industry. As these are considered polluting industries, these industries have to get consent to operate and consent to establish.

3.  Orange Category

These industries cover the pollution index of 41 to 59. Orange category industries cannot commence their business without submitting a consent. And just like in the green category, orange category industries also have to submit consents before establishing and operating the industry.

4.  Red Category

Ministry of Environment & Forests has put excessively polluting industries under the red category. Additionally, these are not allowed to work in an environmentally delicate or under-ensured territory. Every industry that deposits hazardous and noxious materials comes under the Red category industries.

Industries coming under this category are not permitted to function in UP jurisdiction. There are some red-category industries that deal with perilous chemicals, automobiles, mining, Bio-medical waste, etc. The red category covers business sectors whose pollution index is above 60.

Functions of the Uttar Pradesh Pollution Control Board

The Uttar Pradesh Pollution Control Board is mandated to perform certain functions to monitor and control the pollution in Industrial Units in the State of Uttar Pradesh. Some of the major functions and duties of the U. P Pollution Control Board are as follows:

  • Give a proposal to the Uttar Pradesh Government on any issue concerning the prevention and control of water and air contamination and improvement of the nature of air.
  • Conduct consumer awareness programs on the avoidance and control of air and water pollution and waste administration through broad communications.
  • Gather, compile, and prepare a list of technical and statistical data pertaining to air and water contamination.
  • Set out the standard of sewage and exchange effluents for release from modern plants, vehicles, and Health Care establishments.
  • To help with the development of new innovations for the treatment of sewage, exchange effluents, and control hardware.
  • Issuance of consens to ventures falling in various classifications, for example, Orange, Green, and White.

Process of Uttar Pradesh Pollution Control Board (UPPCB) Registration

Industries apply online via UPPCB's portal with site details, registration, and fees for Consent to Establish (CTE) or Operate (CTO). Site inspection may be conducted (mainly for Orange & Red category units). A Regional Officer (RO) may visit your site to verify the pollution control measures. CTO is issued after full compliance. The amount depends on your capital investment and industry category (Red, Orange, or Green). Once approved (usually within 90–120 days), the digital certificate can be downloaded directly from your dashboard. UPPCB teams notify industries before visits to verify operations, raw materials, pollution controls, and records. They collect samples, check compliance with consents, and report violations for corrective action or legal steps.

•    White Category- This Category was introduced for industries that are considered practically non-polluting within a pollution index (PI) of 20 or less. These industries do not require a Consent to Established (CTE) or Consent to Operate (CTO)
 

Pollution Board Registration is required for the construction of Premises (Land) or Installation of machinery (constructed premises).  Application of other licenses which include

The documents required for CTE (Consent to Establish) application generally include a mix of proofs of possession, project and process details technical plans and compliance certificates as outlined by multiple State Pollution Control Boards in India.

The CTE registration is for one year or for completion of work, whichever is earlier are issued by Uttar Pradesh Pollution Control Board (UPPCB). From UPPCB, the extension can also be availed for valid reasons.

The validity of Consent to Operate (CTO) from the Uttar Pradesh Pollution Control Board (UPPCB) depends entirely on the category of the industry. The Validity of Consent to Operate (CTO) in Uttar Pradesh depends on the Category of the Industry:
•    Red Category industries ,the CTO is valid for 5 years
•    Orange Category industries, the CTO is valid 10 years
•    Green Category industries, the CTO is valid for 15 years
•    White Category industries do not require a CTO

Factories must apply for renewal before the expiry of their registration to ensure continuous legal operation.

The procedure for online application for the Uttar Pradesh Pollution Control Registration (CTE/CTO) involves several specific steps on the official portals such as Nivesh Mitra and the OCMMS portal.
•    Register as a new user with personal industry and contact information to generate login Credentials.
•    Log in using your registered credentials and fill out the common Application form for the chosen unit.
•    Upload or submit all requisite supporting documents, including cover letter, site plan, Land use certificate, project report, water/air pollution management scheme and other documents per the category.
•    Pay the prescribed application fee online using the portal’s payment gateway.
•    Categorization: Determine your industry Category (Red, Orange, Green or White) based on its pollution index.
•    Documentation: Gather all the necessary documents such as proof of business registration land documents a detailed project report, Layout plans and proposals for pollution control measures (ETP/STP) APC devices).
