Introduction - Maharashtra Pollution Control Board

The Maharashtra Pollution Control Board (MPCB) is responsible for enforcing various environmental laws within the state of Maharashtra. Primarily, these include the Water (Prevention and Control of Pollution) Act, 1974, the Air (Prevention and Control of Pollution) Act, 1981, and specific provisions outlined in the Environmental (Protection) Act, 1986. Additionally, MPCB oversees the implementation of rules such as the Biomedical Waste (Management and Handling) Rules, 1998, Hazardous Waste (Management and Handling) Rules, 2000, Municipal Solid Waste Rules, 2000, among others. The board operates under the administrative authority of the Environment Department of the Government of Maharashtra.

The Maharashtra Pollution Control Board (MPCB) Registration, often referred to as Consent, is a mandatory legal Authorization required for industries, businesses, and any establishment that discharges pollutants into the environment (air, water, or land) in Maharashtra. After Establishment, the entity must obtain the CTO to legally commence operations, confirming to pollution control norms. Maharashtra Pollution Control Board classifies industries into four categories Red, Orange, Green, and White based on pollution potential, which affects the Consent requirements. The White category typically does not require a consent Registration due to minimal pollution risk. Maharashtra Pollution Control Board enforces Environmental laws like the Water (Prevention and Control of Pollution) Act, 1974, and the Air (Prevention and Control of Pollution) Act, 1981.

Meaning of Maharashtra Pollution Control Board Registration
MPCB Registration means obtaining official consent or authorization from the Maharashtra Pollution Control Board under one or more of the following Acts:
1.    Water (Prevention and Control of Pollution) Act, 1974
2.    Air (Prevention and Control of Pollution) Act, 1981
3.    Environment (Protection) Act, 1986
4.    Hazardous & Other Waste (Management & Trans boundary Movement) Rules, 2016
The registration process allows the MPCB to:
1.    Identify your industry’s pollution category (Red, Orange, Green, or White).
2.    Monitor factroies' compliance with pollution control standards.
3.    Issue consents (CTE/CTO) and authorizations 
 

The Maharashtra Pollution Control Board (MPCB) Consent to Establish (CTE) is a mandatory environmental clearance required before any industry, operation, or process begins construction, erection, or installation within the state of Maharashtra. CTE ensures that the proposed project complies with environmental standards by incorporating pollution control measures in the design and layout before the project begins. 
The process involves submitting a detailed application to MPCB Including:
•    Project report, site plan, manufacturing process details
•    Environmental management and solid waste management plans
•    Consent fees payment
 

The Maharashtra Pollution Control Board (MPCB) Consent to Operate (CTO) is an official authorization required for industrial units, factories, and projects to legally commence their operations after the construction or establishment phase is complete and pollution control systems are in place. MPCB conducts a mandatory site inspection during the CTO process (especially the first CTO) to physically verify the implementation and effectiveness of the Effluent Treatment Plants (ETP), Air Pollution Control (APC) devices, and hazardous waste storage.

The Consent to Operate (CTO) is granted under:
•    Section 25/26 of the Water (Prevention and Control of Pollution) Act, 1974, and
•    Section 21 of the Air (Prevention and Control of Pollution) Act, 1981.
 

To obtain Maharashtra pollution control Registration, it is necessary to submit an application to the Maharashtra Pollution Control Board online portal, along with the required documents and fees. The board will subsequently evaluate the application, taking into consideration factors such as the industry's nature, potential environmental impact, and adherence to pollution control standards. Once satisfied, the MPCB issues CTE, CTO & various waste management authorizations.  

The validity period of Maharashtra Pollution Control Board (MPCB) registration are:

Consent to Establish (CTE)

•    Red Up to 5 years or till project construction is completed (whichever is earlier)
•    Orange Up to 5 years or till project construction is completed
•    Green Up to 5 years or till project construction is completed
•    White Not Required

Consent to Operate (CTO)

•    Red -  1 to 5 years
•    Orange-1 to 5 years
•    Green Up to 10 years
•    White Not Required
 

The documents required for Maharashtra Pollution Control Board (MPCB) 
•    Industry Registration Certificate (e.g., MSME/Udyam Registration, Factory License, SSI/DGTD Certificate).
•    Partnership Deed / Memorandum of Association (MOA) / Articles of Association (AOA), depending on the business structure.
•    PAN Card Copy of the Industry (or Self-Certification if not applicable).
•    Aadhar/PAN Card Copy of the Authorized Person/Proprietor.
•    Chartered Accountant (CA) certificate or audited balance sheet showing capital investment. 
•    Manufacturing process details / process flow‐diagram/flow-sheet.
•    Industry registration / SSI certificate / NOC from Directorate of Industries, Government of Maharashtra. 
•    Land ownership certificate / site allotment or rent/lease document if applicable.
•    NOC from local body / planning authority.
•    Detailed proposal for pollution control systems (air, water, waste) including layout, location of emissions, stack position, etc.

Authorization: Typically means the Board permits a facility or entity (e.g., a recycler, processor, transporter, treatment plant) to handle, process, treat, recover, recycle or dispose of a certain kind of waste under the applicable rule/regulation.
