Rajasthan Pollution Control Board Compliances

Types of Rajasthan Pollution Control Board Registrations

1.    Consent to Establish (CTE)

      --  Required before starting construction or installation of an industry, factory, or facility.
      --  Ensures the project site, layout, and proposed pollution control measures comply with environmental standards.

2.    Consent to Operate (CTO)

      --  Required before starting operations/production.
      --  Confirms that pollution control equipment (like Effluent Treatment Plants, Sewage Treatment Plants, Air Pollution Control Devices, etc.) are properly installed and functional.
      --  Granted for a fixed period (varies by industry category).

3.    Renewal of Consent

       --  Industries must periodically renew their CTO.
       --  Renewal period depends on the industry category:
       --  Red Category (High pollution) – shorter validity (up to 5 years).
           --  Orange Category (Medium pollution) – validity up to 10 years.
           --  Green Category (Low pollution) – validity up to 15 years.

4.    Other Authorizations (depending on activity)

           --  Bio-Medical Waste Authorization (for hospitals, labs, clinics).
           --  Hazardous Waste Authorization (for industries generating chemical/by-product waste).
           --  Plastic Waste Authorization (for plastic producers, recyclers, brand owners).
           --  E-Waste Authorization (for electronic manufacturers, dismantlers, recyclers).
 

For construction of Premises (Land) or Installation of machinery (constructed premises)

The validity of a Rajasthan Pollution Control Board (RSPCB) Registration depends on the type of registration and the category of the industry. The RSPCB classifies industries based on their Pollution Index (PI), which determines the potential for environmental impact.

There are two main types of Registrations:

1.    Consent to Establish (CTE): This is required before the establishment of any industrial project.
       --  Validity: The CTE is generally valid for a period of 3 to 5 years.
       --  Extension: If the project is not completed within this period, the applicant can request an extension. The request for an extension should be submitted before the expiry of the certificate.
2.    Consent to Operate (CTO): This is required before the commencement of operations after the industry has been established. The validity of a CTO is directly linked to the industry's category.
       --  Red Category: Industries with a high pollution potential (PI > 60) are granted a CTO with a validity of 5 years.
       --  Orange Category: Industries with a medium pollution potential (PI between 41 and 59) are granted a CTO with a validity of 10 years.
       --   Green Category: Industries with a low pollution potential (PI between 21 and 40) are granted a CTO with a validity of 15 years.
       --  White Category: Industries with a minimal pollution potential (PI < 20) are generally exempt from the consent mechanism and only need to notify the RSPCB.
 

Documents Required for CTE Application in Rajasthan
1.    Application Form
      --  Filled through RSPCB OCMMS (Online Consent Management & Monitoring System) portal.
2.    Covering Letter
     --  Request letter on company letterhead addressed to RSPCB.
3.    Land/Property Documents
     --  Proof of ownership/lease of land (sale deed, lease deed, rent agreement, allotment letter, etc.).
4.    Site/Location Plan
     --  Detailed layout of the project site with nearby features (villages, roads, rivers, schools, etc.).
5.    Project Report / Detailed Proposal
     --  Description of manufacturing process, raw materials, machinery, capacity, etc.
6.    Flow Diagram of Manufacturing Process
     --  With details of inputs, outputs, effluents, and emissions.
7.    Water Balance and Wastewater Details
     --  Sources of water, consumption, wastewater generation, proposed treatment/disposal system.
8.    Air Pollution Control Details
     --  Fuel usage, stack details, expected emissions, and pollution control equipment (like bag filters, scrubbers, ESPs).
9.    Solid & Hazardous Waste Management Plan
     --  Quantity, type of waste, storage, treatment, and disposal method.
10.    Consent Fee Payment Receipt
     --  As per industry category (Red, Orange, Green).
11.    Company/Unit Registration Documents
     --  Certificate of Incorporation/Partnership Deed/Udyam Registration/MSME Certificate.
12.    Power Requirement & Source Details
     --  Electricity sanction letter or DG set details (if applicable).
 

The Rajasthan Pollution Control Board (RSPCB) Registration is mandatory for any activity, industry, or facility in Rajasthan that has the potential to pollute air, water, or land or generates waste (solid, hazardous, biomedical, e-waste, plastic, etc.). This is a legal requirement under the Water (Prevention and Control of Pollution) Act, 1974, and the Air (Prevention and Control of Pollution) Act, 1981.

1.  Industrial & Manufacturing Units

Any unit engaged in manufacturing, processing, or assembling needs RSPCB consent. Examples:
    --  Large-scale industries: Cement plants, textile dyeing & printing, chemical, paper mills, tanneries, steel, sugar, pharmaceuticals.
    --  Medium/small units: Food processing, packaging, paint, detergent, plastic manufacturing, electroplating.
    --  Stone crushers, brick kilns, distilleries, foundries, workshops.

2.  Healthcare Facilities

All facilities generating biomedical waste, such as:
    --  Hospitals, nursing homes, clinics, veterinary hospitals.
    --  Pathology labs, blood banks, diagnostic centers, dental clinics.
 

3. Hotels, Restaurants, and Resorts

    --   Hotels, lodges, guest houses, banquet halls, resorts.
Needed because they generate sewage, solid waste, and sometimes hazardous waste.

The procedure for an online application for a Rajasthan Pollution Control Registration is a streamlined process primarily conducted through the state's online portals. The process is designed to be user-friendly, transparent, and efficient.
The entire process, from initial registration to the final certificate issuance, is managed online through the Raj Nivesh or Rajasthan Single Sign-On (SSO) portal.

Login and Registration

1.    Access the Portal: Navigate to the official Raj Nivesh portal or the Rajasthan SSO portal.
2.    Login: Use your existing Rajasthan SSO ID to log in.
3.    New User Registration: If you are a new applicant, you will need to register your establishment or industrial unit through the portal. This is a one-time activity. The system will create a unique ID for your unit.

Select the Application Type

1.    After logging in, go to the "Applications" or "Online Services" section.
2.    From the list of services offered by the Rajasthan State Pollution Control Board, select the appropriate application type:
      --  Consent to Establish (CTE): For new industries or projects before construction.
      --   Consent to Operate (CTO): For established industries that are ready to commence operations or for renewal of an existing certificate.
      --  You will also need to specify if the application is for the Water Act, Air Act, or both.

Upload Required Documents

The portal will provide a checklist of the documents you need to upload. All documents must be scanned and uploaded in the specified format (usually PDF). Common documents include:
      --  Proof of land ownership or lease agreement.
      --  Detailed Project Report (DPR).
      --  Certificate of capital investment from a Chartered Accountant (CA).
      --  Site and layout plans.
      --  Copies of PAN and Aadhar Card of the proprietor/directors.
      --  Environmental Clearance (EC), if applicable.
      --  Consent fee receipt (after online payment).

Pay the Application Fee

      --  The application fee is automatically calculated by the system based on your project's capital investment and industry category.
      --  You can pay the fee online through the Rajasthan Payment Platform using various modes like net banking, debit/credit cards, or e-wallets.
      --  An option for offline payment via bank challan is also available.
 

For the green and Orange categories, the Government fee depends on a letter issued by the Chartered Accountant, stating the total project cost of the business, and the cost incurred in setting up a business enterprise. The laboratory testing fee ranges between Rs.5,000 to Rs.10,000 for Boiler, Oil and Grease Trap, Effluent Treatment Plant (ETP) or Sewage Treatment Plant (STP).
