  • The Jammu & Kashmir Pollution Control Board was established as per a notification on the 8th of March, 1987 under the Water (Prevention and Control of Pollution) Act of 1974.
  • The Board has been carrying out its responsibilities under the terms of the Water (Prevention and Control of Pollution) Act of 1974 and the Air (Prevention and Control of Pollution) Act of 1981. The Board was given additional responsibility in order to pass the Environment (Protection) Act of 1986 (EPA). the EPA has a vast regulatory and developmental domain in the subject of Environment Management, which is an umbrella Act and many Rules enacted under this Act from time to time addressing the various aspects of pollution.

Objectives of the Jammu & Kashmir Pollution Control Board (JKPCB) Registration?

J & K State Pollution Control Board is a statutory authority that was established in 1987 under the Water (Prevention and Control of Pollution) Act, 1974 and is vested with powers under that act, as well as the Air (Prevention and Control of Pollution) Act, 1981, and the Environment Protection Act, 1986, and various Rules made thereunder, to abate and control environmental pollution. The main gaol’s of this board are as follows:

  • Control of Industrial production in the state through the issuance of permits under the Air and Water Acts for the construction and operation of industrial units.
  • To record and share information about noise, water, and air pollution and how to prevent and regulate it.
  • Granting Authorization in accordance with the 2008 Hazardous Waste (Management, Handling, and Transboundary Movement) Rules Regulations created y the Environment Protection Act of 1986, including the Biomedical Waste (Management & Handling) Rules and other authorization.
  • Implementation of various Environmental Laws.
  • To provide the State government with advice on any issue relating to pollution prevention, control, and abatement.
  • Industrial units are required to be watched over and monitored.

How are Industries Categorized Under the Jammu & Kashmir Pollution Control Board (JKPCB) guidelines?

The Jammu and Kashmir State Pollution Control Committee has released a list of industrial units in accordance with the notification passed by the Central Pollution Control Board and processes broken down into Red, Orange, Green, and White categories, all of which are fully consistent and similar to the serial numbers in the CPCB list, in order to make it easier to work and share information online through the India E-track Web Portal. Several types of units are categorized under the Red category, the Green category, the Orange category, and the White category in the recently modified list.

The State Pollution Control Board must grant industrial units listed under the Red, Orange, and Green categories permission to construct and operate, although those listed under the White category are exempt from these restrictions. Depending on the Pollution Index of the sectors in each zone, the OPCB categorizes industries. The Pollution Index has a scale of 0 to 100, with 100 denoting the most pollutant emissions from units. The following industries are divided into categories:

  • Red Category: Pollution Index of 60 or more.
  • Orange Category: Calculating from 41 to 59 on the Pollution index.
  • Green Category: Calculating from 21 to 40 for the Pollution Index.
  • White Category: Pollution Index up to less than 20.

What Consent is required under the Jammu & Kashmir State Pollution Control Board (JKPCB) Compliance?

  • Consent to Establish (CTE)

All industrial projects and units that fall into the Red, Orange, or Green Categories under the consent management guidelines of the Jammu & Kashmir Pollution Control Board, are required to get a Consent to Establish (CTE) from the Board. This Consent to Establish means that the business entity has the permission of the Jammu & Kashmir Pollution Control Board to complete the infrastructure requirements of the proposed business, such as constructing the factory premises/commercial building & install the required machinery and other equipment. The CTE is generally issued for one year, which can be extended further. Once everything is ready & primed, the business entity may then apply for Consent to Operate (CTO). The industrial units falling under the White Category are excused from getting consents CTE & CTO. Instead, they just need to notify the Board, which is sufficient.

  • Consent to Operate (CTO)

After the completion of infrastructure & material requirements of the business process, when the business set-up is ready to get operational, the applicant is required to apply for & get the Consent to Operate (CTO) from the Jammu & Kashmir Pollution Control Board. The validity of this CTO is 5 years for the red/orange category & 10 years for the green category of business activities.

Process of Jammu & Kashmir Pollution Control Board (JKPCB) Registration

JKPCB registration is mandatory for industries, businesses, and projects that may cause air, water, or waste pollution in Jammu & Kashmir. Registration is granted in the form of Consent to Establish (CTE) and Consent to Operate (CTO). It is primarily managed through the Online Consent Management & Monitoring System (OCMMS) and often linked with the J&K Single Window Portal for ease of doing business. White category units often get exemptions or auto-approvals; others receive decisions within 20-30 days for CTE, up to 4 months including inspections. Track status online approved consents are downloadable as digital certificates. Pay the processing fee online (calculated based on your Capital Investment). If approved, a digitally signed CTE certificate is issued. Submit analysis reports from a JKPCC-empanelled laboratory for air/water quality. An Environmental Engineer will inspect the site to verify that everything matches the CTE conditions.

Types of JKPCB Registrations

  • -- Required before starting operations.

3.    Waste Management Authorizations:

A Registration from the Jammu & Kashmir Pollution Control Board is required by any private business or a Government agency having a factory or a manufacturing facility, a hotel or a restaurant or running a health care establishment such as hospitals, clinics, or laboratories. 

The online procedure for applying for a Pollution Registration (Consent) in Jammu & Kashmir.

The Jammu & Kashmir Pollution Control Committee (JKPCC) has an Online Consent Management & Monitoring System (OCMMS) through which all pollution-related approvals (CTE, CTO, and Authorizations) are applied.

Registration on the OCMMS Portal

1.    Visit the official website of JKPCC OCMMS (Online Consent Management & Monitoring System).
2.    Create a new user account:
• Enter applicant details (Name, Email, Mobile number).
• Choose your type of unit (Industry, Hospital, Hotel, Clinic, etc.).
• Set login ID and password.
3.    A confirmation mail/SMS is sent, and your account is activated.

Login & Select Application Type

1.    Login to the OCMMS portal with your ID & password.
2.    Select the required service:
• Consent to Establish (CTE) – if the unit is not yet set up.
• Consent to Operate (CTO) – if the unit is ready to start operations.
• Authorization – if handling hazardous, biomedical, plastic, or e-waste.
3.    Fill the application form online.

Applicants must upload self-attested scanned copies in PDF format. Typical documents include:
• PAN  & Aadhar of applicant.
• Company incorporation/partnership/MSME/GST certificate.
• Land ownership/lease/rent agreement.

The consent document which is also known as Pollution Registration or Pollution Board Permission is the document being issued to the applicant by the Jammu Kashmir Pollution Control Board. For the establishment of the factory, firstly a Consent to Establish (CTE) is issued and when the business becomes operational then a Consent to Operate (CTO) is issued.

The application fee for getting a Pollution Registration (Consent) in Jammu & Kashmir depends mainly on:

1.    Type of Consent:

--  Consent to Establish (CTE) – before setting up a unit.
--  Consent to Operate (CTO) – before running/renewing a unit.
--  Authorizations – for waste management (biomedical, hazardous, e-waste, plastic).

2.    Category of Industry/Unit:

--  White Category – Non-polluting (very low or no fee, sometimes only intimation).
--  Green Category – Low pollution potential (small fee).
--  Orange Category – Moderate pollution potential (medium fee).
--  Red Category – High pollution potential (highest fee).

3.    Capital Investment of the Unit:

--  The fee increases with project cost/investment in land, building, and machinery.
-- Larger factories/projects pay more compared to small workshops or service units.

             White Category

  • •    Mostly exempted from fees.
  • •    Only require an intimation letter/declaration.

     Green Category

  • •    Consent Fee: ₹1,000 to ₹25,000 (depending on investment).
  • •    Example: A small hotel, bakery, or workshop will pay lower fees, while a large green-category factory will pay higher.

             Orange Category

  • •    Consent Fee: ₹2,000 to ₹50,000+ (depending on investment).
  • •    Example: Medium-level industries like food processing units, printing presses, packaging units, etc.

           Red Category

  • •    Consent Fee: ₹25,000 to several lakhs, depending on the size and investment.
  • •    Example: Cement plants, chemical industries, large manufacturing factories.

Note: Many red category industries are restricted/prohibited in J&K.
 

Categories of Industries Requiring JKPCB Registration

1.  Red Category (High Pollution Potential)

  • •    These are industries that cause significant pollution and require strict monitoring.
  • •    Examples:
  • -- Thermal power plants
  • -- Integrated iron & steel plants
  • -- Cement manufacturing
  • -- Tannery & leather processing
  • -- Petroleum refineries
  • -- Pulp & paper industries
  • -- Large-scale textile units (with dyeing/printing)
  • -- Fertilizer, pesticide & chemical manufacturing

Requirement: Mandatory CTE & CTO from JKPCB before establishment and during operations.

2. Orange Category (Moderate Pollution Potential)

  • •    These industries generate moderate levels of pollution but can be controlled with proper systems.
  • •    Examples:
  • -- Food & beverage processing (dairy, meat, breweries)
  • -- Paints & dye manufacturing
  • -- Printing press with chemical usage
  • -- Hotels/resorts with more than 20 rooms or with laundry/kitchen
  • -- Automobile servicing/repair workshops
  • -- Surface coating/galvanizing units

Requirement: License is compulsory; compliance monitoring is regular but less stringent than Red.

3. Green Category (Low Pollution Potential)

  • •    These industries cause minimal pollution.
  • •    Examples:
  • -- Assembly of electronic items
  • -- Solar panel assembly units
  • -- Handloom & handicraft units
  • -- Software/IT parks (with DG sets)
  • -- Bakeries & sweet shops (small-scale, using LPG/electricity)
  • -- Printing press (non-chemical, digital type)

Requirement: Consent required but the process is simplified.

4. White Category (Practically Non-Polluting)

  • •    Introduced by CPCB in 2016 to promote ease of doing business.
  • •    These units are almost non-polluting.
  • •    Examples:
  • -- Chalk making units
  • -- Glass bangle making (without furnace)
  • -- Cotton ginning & pressing
  • -- Medical oxygen manufacturing
  • -- Packaging of food items without processing
  • -- Insulated wires and cables (PVC extrusion)

Requirement: Only an intimation to JKPCB is required (no Consent/CTE/CTO).
 

As per Jammu & Kashmir Pollution Control Board Guidelines, no business should establish or operate without the prior consent/permission from the Jammu & Kashmir Pollution Control Board.

The white category manufacturing activity, only Undertaking is to be submitted to the Pollution Board & the acknowledgement is issued in 7 – 10 days. For the Green, orange & red category business activities, two registrations are required, Consent to Establish (CTE) & Consent to Operate (CTO). Both these registrations can be issued in 30 – 45 days each.

The Jammu & Kashmir Pollution Control Board has an online portal for applying for any pollution board Registration. The applicant can visit the official website of the Jammu & Kashmir Pollution Board and upload his/her details and submit Govt fee online. The Registration is also uploaded on the portal only, which can then be downloaded from the same portal.

The Pollution Control Registration issued by the Jammu & Kashmir Pollution Board come with a certain validity period. It is mentioned on the certificate itself. The white category certificate has a validity of 7 years, green category CTO has a validity of 10 years. The orange category consent has a validity of five years while the red category consent may have validity of 1-5 years.

The Jammu & Kashmir Pollution Board is mandated to penalize the entities found to be violating the pollution board guidelines. The penalty could range from Rs.10,000 to Rs.50,000, depending on the nature of business activity and the quantity of air, water or noise pollution thus generated. Also, the Pollution Board is authorized to issue show cause notices and even issue closure notice to any business.

No. This Regstration is non-transferrable. The Jammu & Kashmir Pollution Board Registration, Consent to Establish (CTE) & Consent to Operate (CTO) is issued to a business entity name and for the particular address. Any change in ownership & address change require the applicant to inform the Pollution Board and get the name or address changed on the existing certificate or he/she may require to file a new application.

When an applicant registers at the Jammu & Kashmir Pollution Board online portal, he/she is issued a login Id and a password. The same can be used to access the online portal and track the applications.

Once the applicant files an online application to Pollution Board for a particular Registration / Authorization, his/her application is forwarded to the concerned Official. The concerned official reviews the application and may ask for additional documents to be submitted. Once that is done, the official is mandated to perform site inspection and cross check all the details submitted in the application.

Any business, be it micro, small, medium or large enterprise, is required to get pollution board Registration before the commencement of the business activity. The Jammu Kashmir Pollution Board may exempt some business activities in the white category businesses, from time to time, but even then an undertaking is required to be submitted online.

Once the Pollution Registration is issued, the applicant has to submit annual compliances, once in a year, to the State Pollution Control Board, showing that all the conditions mentioned in the certificate are being fulfilled. Also, the fitness reports of the pollution control equipment is to uploaded from time to time to ensure the smooth working of these pollution control devices.
